CA Proposed Fine for Process Servers 2010

The California Legislature just amended a bill proposal that had to do with credit cards to something completely different having to do with process serving. If the process server fails to comply, such as announcing who they are and serving at the CORRECT address, they could lose their license and pay a big fine. And get this- the person (attorney ) who gave them the wrong address to serve at could also be fined!

“SB984 just amended proposal would fine process server $10,000 and loss of license for failing to state their full name, here to serve process, and upon whom when someone opens the door. Fine $25,000 for serving the wrong address and loss of license. Also $25,000 fine to person who gave them wrong address for service if they didn’t find address themselves.”

It covers all areas of practice (revising the Civil Code & CCP on service requirements), requires service at a residence to be only from 7am to 8pm, allows for fines in excess of $10,000 for violations as well as for the loss of license, and can potentially impact attorneys who hire process servers and Private Investigators who supply information.

They attached this to the new credit card controls that require credit card companies to inform customers of rate changes, etc.
